Understanding the TDS Sections: 194-IA, 194-IB, 194M, and 194S

1. Section 194-IA – TDS on Purchase of Immovable Property

  • Applicable when purchasing immovable property (excluding agricultural land) for a value of ₹50 lakh or more.
  • TDS Rate: 1% of the transaction value.
  • Who Pays? The buyer is responsible for deducting TDS before making the payment to the seller.

2. Section 194-IB – TDS on Rent Paid by Individuals/HUFs

  • Applicable when an individual or HUF (not subject to tax audit) pays rent exceeding ₹50,000 per month.
  • TDS Rate: 5% on total rent paid.
  • Who Pays? The tenant must deduct TDS and deposit it with the government.

3. Section 194M – TDS on Payments to Contractors & Professionals by Individuals

  • Applicable if an individual or HUF (not liable to tax audit) pays more than ₹50 lakh in a financial year to a contractor or professional.
  • TDS Rate: 5% of the payment amount.
  • Who Pays? The individual/HUF making the payment must deduct TDS.

4. Section 194S – TDS on Virtual Digital Assets (Crypto, NFTs, etc.)

  • Applicable when transferring virtual digital assets (VDAs) such as cryptocurrency or NFTs.
  • TDS Rate: 1% of the transaction value.
  • Who Pays? The buyer is responsible for deducting TDS before making the payment.

Consequences of Missing the TDS Payment Due Date

Failure to deposit TDS on time can lead to:
Interest Charges: 1.5% per month until the amount is deposited.
Late Fee: ₹200 per day under Section 234E until the TDS return is filed.
Penalty: Under Section 271H, penalties may range from ₹10,000 to ₹1,00,000 for non-filing or incorrect filing of TDS returns.

How to Pay TDS Online?

Follow these steps to make a hassle-free online TDS payment:

1️⃣ Visit the official Income Tax Department website: https://www.incometax.gov.in
2️⃣ Navigate to "e-Pay Tax" under the quick links section.
3️⃣ Choose "Challan No./ITNS 281" for TDS/TCS payment.
4️⃣ Select the appropriate assessment year and section under which you are making the payment.
5️⃣ Enter the TAN details, payment amount, and proceed with payment using net banking/debit card.
6️⃣ After payment, download the Challan Receipt (CIN) for records.
